Privacy Act 2020 (New Zealand)

1. Authority to Obtain Credit Information

I understand that you BLACKHAWK Ltd operating as Bravo Finance, are asking me for personal information about me so as to use Equifax’s credit reporting service to credit check me.

Equifax will give you information about me for that purpose. 

  • You will give my personal information to Equifax and that Equifax will hold that information on their systems and use it to provide their reporting service.
  • When other Equifax customers use the Equifax credit reporting service, Equifax may give the information to those customers.
  • If I default in my payment obligations to you, information about that default may be given to Equifax, and Equifax may give information about my default to other Equifax customers. This includes the authority to access my credit history, repayment history, account defaults, credit limits, and any other relevant information.

2. Purpose of Collection

I understand that the information collected will be used:

  • To assess my application for finance or ongoing suitability for credit arrangements.
  • For risk assessment, debt collection (if required), or compliance with legal obligations.

3. Consent to Disclose

I consent to the disclosure of my personal and credit-related information:

  • To BLACKHAWK Ltd operating as Bravo Finance, and their associated entities for the purposes listed above.
  • To credit reporting agencies and other lenders as required for the purpose of credit assessment.
  • To debt collection agencies, legal advisers, or regulatory bodies if necessary.

4. Rights Under the Privacy Act

I understand that under the Privacy Act 2020:

  • I have the right to access and request correction of any personal information held about me.
  • My information will be stored securely and used only for lawful and authorised purposes.

5. Retention and Use

I acknowledge that my personal and credit information may be retained for a reasonable period after any relationship with Bravo Finance or Blackhawk Capital has ended, to comply with legal and business requirements.

6. Voluntary and Informed Consent

I confirm that:

  • I have read and understood this authority.
  • I am providing this information voluntarily.
  • I have had the opportunity to ask questions about how my information will be used.
